January 4, 2018 Supervisors comply with federal weapon-ban order

By a 4-1 vote Wednesday, Dec. 27, the Washington County supervisors approved compliance with the Iowa State Judicial supervisory order banning weapons in state courtroom areas. Voting followed an explanation from County Attorney John Gish about the Supreme Court’s issuance of the ban earlier this month regarding no weapons in courtroom spaces.

However, the ban does not extend to “publicly controlled spaces,” Gish said.

That means only the third floor of the Washington courthouse, which contains the district courtroom, magistrate’s court and court offices, will be affected by the ban.

During the discussion, Supervisor Jack Seward Jr. asked if use of the courtroom for public meetings, specifically legislative briefings during the beginning of the year, would fall under the ban.

Gish said that it would still be the courtroom, so the ban should apply.

Until Wednesday’s vote, there was no explicit ban regarding weapons in the courthouse.

Prior to the vote, Supervisor Bob Yoder suggested the board delay the action to allow for further consideration. It was noted that the ban is not a request but a court order. Yoder opposed the motion for approval that would allow Gish to prepare a letter to send to the court regarding the county’s compliance.
